These Terms govern your use of the finnly mobile app and website. By using finnly, you agree to them. Please read them carefully, especially the disclaimers and limitation of liability.
These Terms and Conditions (the “Terms”) form a binding agreement between you and Havilah Works Oy(“finnly”, “we”, “us” or “our”) governing your access to and use of the finnly mobile application (the “App”) and the website at getfinnly.com (together, the “Services”). By downloading, accessing or using the Services, you confirm that you accept these Terms. If you do not agree, do not use the Services.
Eligibility
You must be at least 16 years old, or the age of digital consent in your country, to use the Services. By using the Services you represent that you meet this requirement and that you are able to enter into a binding contract.
Licence to use the Services
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Services for your own non-commercial language learning. You may not copy, modify, distribute, sell, reverse engineer or create derivative works from the Services or their content, except as expressly permitted by law.
Subscriptions, trials and payment
- Certain features require a paid subscription. Subscriptions are sold and billed through the Apple App Store or Google Play, and are subject to the applicable store’s terms in addition to these Terms.
- Where a free trial is offered, you may be charged automatically when the trial ends unless you cancel beforehand. Subscriptions renew automatically for the chosen period until cancelled.
- You can manage or cancel your subscription, and turn off auto-renewal, in your Apple App Store or Google Play account settings. Cancelling stops future renewals but does not retroactively refund the current period.
- Refunds are handled by the relevant app store in accordance with its policies and applicable consumer-protection law. We do not separately process payments and generally cannot issue refunds directly.
- Prices may change; any change will apply only to future billing periods.
Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in breach of these Terms;
- Attempt to gain unauthorised access to, disrupt or interfere with the Services or their underlying systems;
- Submit content that is unlawful, abusive or infringes the rights of others through the writing or speaking features;
- Use any automated means to access the Services or to extract content at scale, or resell or redistribute the Services or their content.
Your content
You retain ownership of the text and voice recordings you submit through the Services (“Your Content”). You grant us a limited licence to process Your Content solely to provide the relevant features, such as generating AI feedback, and to maintain and improve the Services, as described in our Privacy Policy. You are responsible for Your Content and confirm you have the right to submit it.
Intellectual property
The Services and all of their content, including learning materials, audio, text, software, designs, the finnly name and logo, are owned by us or our licensors and are protected by intellectual property laws. Except for the licence expressly granted above, no rights are transferred to you.
No guarantee of results — educational use only
finnly is an independent study aid intended to support your own learning. It is not a guarantee of any particular outcome, score or result, and we do not promise that using the Services will enable you to pass the YKI exam, any other examination, or achieve any level of language proficiency. Your results depend on many factors outside our control, including your own effort, prior knowledge and circumstances. Any progress estimates, projections, levels or feedback provided by the Services are indicative only and must not be relied upon as a prediction or assurance of performance.
finnly is not affiliated with, endorsed by, or operated bythe Finnish National Agency for Education, the official YKI exam administrators, or any government or examination authority. “YKI” and any other examination names are used only to describe the exams the Services may help you prepare for. The Services do not constitute official exam preparation, legal, immigration or professional advice, and you remain solely responsible for verifying official exam requirements and for your own decisions and outcomes.
Disclaimer of warranties
The Services and all content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any content, translation, grading or feedback is accurate, complete or current. To the maximum extent permitted by law, we disclaim all such warranties.
Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or opportunity, or for any failure to achieve any exam result or learning outcome, arising out of or relating to your use of (or inability to use) the Services. To the extent we are found liable, our total aggregate liability for any claim relating to the Services is limited to the greater of the amount you paid us for the Services in the twelve months before the claim, or EUR 50.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including your statutory consumer rights and any liability for death or personal injury caused by negligence or for fraud.
Third-party services
The Services rely on third-party providers (for example, the app stores, and our analytics, subscription and infrastructure providers). We are not responsible for the acts, omissions, content or policies of those third parties, and your use of their services may be subject to their own terms.
Termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Services. Provisions that by their nature should survive termination — including intellectual property, disclaimers and limitation of liability — will continue to apply.
Changes to the Services and these Terms
We may modify, suspend or discontinue any part of the Services at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of Finland, without regard to conflict-of-laws rules, and the courts of Finland will have jurisdiction over any dispute, unless mandatory consumer- protection law in your country of residence provides otherwise. This does not deprive you of the protection of mandatory provisions of the law applicable where you live.
